| dc.description.abstract | The work in question deals with the analysis of the division of inheritance between the ascendants within the multiparental family. The concept of family, has undergone several changes over the years, especially after the advent of the Federal Constitution of 1988, which expanded the concept of a family entity to encompass the different social realities of Brazil. The family came to be seen, no longer as an institution of the State, but as an instrument of satisfaction of the happiness of its components, thus respecting the dignity of its members. In this sense, in 2016, the Supreme Court recognized the possibility of concomitance between socioaffective and biological paternity, ensuring legal effects to both, thus, there was the legitimation of the so-called multiparental family. In the context of legal effects, it is necessary to examine how the right of successions will suffer these impacts, especially on the ascending line, with a view to respecting, as a priority, the constitutional principles of the dignity of human person and the social function of property. Thus, this work aims to point out the importance and urgency of discussing how to divide the inheritance of the pre-dead child among the ascendants in the multiparental family, since there is no legal provision in this sense, based on human dignity and the social function of inheritance. | pt_BR |
| dc.description.resumo | O trabalho em questão versa sobre a análise da divisão da herança entre os ascendentes no âmbito da família multiparental. O conceito de família, sofreu diversas mudanças ao longo dos anos, principalmente, após o advento da Constituição Federal de 1988, que expandiu o conceito de entidade familiar para abarcar as diferentes realidades sociais do Brasil. A família passou a ser vista, não mais como instituição do Estado, mas como instrumento de satisfação da felicidade de seus componentes, respeitando, assim, a dignidade de seus membros. Nesse sentido, em 2016, o Supremo Tribunal Federal reconheceu a possibilidade de concomitância entre a paternidade socioafetiva e a biológica, garantindo efeitos jurídicos a ambas, assim, houve a legitimação da chamada família multiparental. No âmbito dos efeitos jurídicos, é necessário analisar de que maneira o direito das sucessões sofrerá estes impactos, principalmente na linha ascendente, tendo em vista que se deve respeitar, prioritariamente, os princípios constitucionais da dignidade da pessoa humana e da função social da propriedade. Assim, este trabalho objetiva apontar a importância e a urgência de se discutir a forma de divisão da herança do filho pré-morto entre os ascendentes na família multiparental, uma vez que não há previsão legal neste sentido, tendo como fundamentos a dignidade humana e a função social da herança. | pt_BR |
