Acesso em:.https://bdm.ufpa.br/handle/prefix/4732This research work provides an analysis of the Municipal Plan for Integrated Solid Waste Management (PMGRIS) and how it can be made possible, according to Federal Law nº 12.305/2010 on the National Solid Waste Policy (PNRS) and infraconstitutional legislation on solid waste, which ends up complementing the Policy, aims to demonstrate the need to implement the PNRS instruments, in particular PMGIRS. Initially, the work presents a brief history of solid waste (garbage) and all the negative consequences caused by excess consumption and disposal after the industrial revolution. In addition, shows the current concept of solid waste and its classification according to its origin established by the National Solid Waste Policy, in this context, sustainable development is addressed, in which an analysis of the fundamental right is made, protected by the Brazilian Federal Constitution of 1988, which is the right to a healthy intergenerational environment. Another important point studied in the present work is the municipality within the scope of its environmental competence to legislate and establish public policies in relation to matters of local interest. Analysis supported by the historical-legal method to understand the legal norms that regulate the management of solid waste and to understand the current context of the problem of solid waste in the reality of Brazilian municipalities, we use the methodology with a qualitative approach of an analytical and exploratory character. Bibliographic and documentary research techniques are also applied.
