To do this, a literature review will be conducted on the subject, as well as an analysis of current jurisprudence, using the digital archives of Brazilian courts, with the aim to demonstrate the civil responsibility for violated rights, such as the right to an image, personality, health, and the damages caused, based on the principle of the best interest of the child. As this is a relatively new and underexplored topic, this study aims to shed light on the subject and respond to pertinent questions about the damages that overexposure can cause to children and adolescents whose personality rights are violated by their legal guardians who have a duty to protect them. The study highlights the importance of holding them accountable for this violation and distinguishing between the duty of care and freedom of speech. Research has shown that overexposure of children to the internet can cause various damages by violating their personality rights, and that parental freedom of expression cannot exceed their parental duty to their children; thus, a civil liability role not only plays a significant role in compensating for the damages caused but also preventing future harm.
