Acesso em:.https://bdm.ufpa.br/jspui/handle/prefix/7472This work aims to analyze decisions handed down by the Federal Supreme Court (STF) on the retroactivity of the Criminal Non-Prosecution Agreement (ANPP), provided for in art. 28-A of the Code of Criminal Procedure (CPP), inserted by Law No. 13,964/2019 (Anti-Crime Package), in criminal actions initiated before the law that established it came into force. Considered a rule of mixed nature, the current divergence lies within the temporal limit of its retroactive application to cases in progress when the law came into force. In the development of the article, the existing controversy in the First Panel of the STF will be demonstrated, which limits the application to cases whose complaint has not yet been received, while the Second Panel has recognized the applicability of the institute to all those processes that have not yet been processed. judged. The disagreement over the institute's time limit still looms and generates legal uncertainty in the national order, while the decision of the Habeas Corpus judgment no. 185913 by the full Court of the STF is still awaited.
