Acesso em:.https://bdm.ufpa.br/jspui/handle/prefix/6438This paper aims to analyze the recognition of the employment relationship in labor relations provided through the use of digital platforms, under the aspect of the existence of algorithmic subordination, which implicitly and through new technologies has been used by large companies to escape labor charges and increase their own profit, while thousands of workers have their rights neglected through the idea of being only autonomous workers. Firstly, this paper seeks to define the function of labor law, the difference between labor and employment relationships in the current Brazilian labor legislation, and the elements that characterize the employment relationship. Subsequently, the concept of subordination under its classical aspect and its current developments, within the technological context and the internet, will be presented, culminating in the recognition of the existence of the new mode of algorithmic subordination. Finally, an analysis of court decisions will be presented regarding the recognition or not of the employment relationship, especially the recent position of the 8th Panel of the Superior Labor Court in RRAg-100853-94.2019.5.01.0067 that recognized the existence of the employment relationship between a driver and Uber. Therefore, we conclude that it is necessary that Labor Law be applied correctly, taking into consideration that the labor phenomenon is not static, but dynamic and evolves along with society, therefore, it is necessary to refine it so that it fully complies with its main objective, which is to protect the worker.
