A influência da cobertura da mídia nos casos de competência do tribunal do júri: a linha tênue entre a liberdade de imprensa e a imparcialidade jurídica. It begins with an examination of the Jury Court, its origins, and its legal and constitutional provisions, highlighting the importance of juror impartiality. The discussion then turns to the press, its origins, and constitutional protection, and, by analyzing nationally relevant jury cases such as the Nardoni and Richthofen trials, as well as illustrating the media’s daily coverage of other types of crimes, the thesis is substantiated that sensationalist and aggressive media practices directly harm the Jury Trial by influencing lay jurors and shaping preconceived notions about the defendant, thereby undermining impartiality and violating the defendant’s fundamental rights. It is further shown that the most prominent Brazilian legal doctrine supports this thesis, as does legal scholarship, although neither delves deeply into possible solutions to the issue. The article also presents four proposed approaches, among which, upon comparison, it is understood that desaforamento (transfer of venue), provided for in criminal procedural law, is effective, but only within certain geographical limitations, while the defendant’s waiver of the Jury Trial emerges as the stronger legal mechanism to ensure impartiality of judgment, if adopted. Moreover, better juror instruction and possible sanctions against media conduct in such cases are considered collaborative measures, though insufficient to secure the necessary impartiality.Acesso AbertoDireitos fundamentaisImparcialidadeMídiaTribunal do júriFundamental rightsJudicial impartialityMediaJury courtCNPQ::CIENCIAS SOCIAIS APLICADAS::DIREITOA influência da cobertura da mídia nos casos de competência do tribunal do júri: a linha tênue entre a liberdade de imprensa e a imparcialidade jurídicaThe influence of media coverage on cases subject to trial by jury the delicate balance between freedom of the press and judicial impartialityTrabalho de Curso - Graduação - ArtigoAttribution-NonCommercial-NoDerivs 3.0 Brazil
