Acesso em:.https://bdm.ufpa.br/handle/prefix/8283The present monograph investigates the interpretation of the Brazilian Supreme Federal Court (STF) regarding the forum by prerogative of function, analyzing the votes of the rapporteurs in the judgments of Criminal Action 937-QO (2018) and Habeas Corpus 232627 (2024). The central issue lies in the need to identify how interpretative factors are used and how they relate to the STF's jurisprudential oscillation, which alternates between restricting and expanding the forum. The objective is to identify the interpretative factors employed, the weight assigned to each, their application, and their relationship with the overall reasoning of the vote. Additionally, on a secondary level, the study analyzes the political context and its connection to the decisions, aiming to understand how the Court seeks legitimacy and institutional authority amid political crises and social pressures. This research, based on a qualitative approach and explanatory method, analyzes votes, legal doctrine, and precedents to comprehend the STF’s decision-making dynamics.
