It aims to defend its practical viability as a tool for addressing dissent in the discursive practice of law. Using a deductive methodology, each section corresponds to an argumentative stage in which reasons are provided for the acceptability of the proposed premises. It is argued that Alexy's theory offers rational criteria for the justification of judicial decisions, particularly in cases involving interpretative divergences in law, such as conflicts between norms and specifically between principles. The analysis culminates in defending the thesis that there is a philosophical-legal problem in the application and interpretation of law to which the theory of argumentation provides an adequate response. The article also discusses criticisms raised by Manuel Atienza in order to assess the applicability of Alexy's theory in real court rulings.
