To this end, the inductive method is adopted, with bibliographic and documentary research, as well as qualitative analysis of data extracted from the access panels of public security agencies. Initially, the operational model of the Genetic Database is discussed, including its implementation, justifications, and legal basis. Next, Appeal No. 973.837/MG is addressed, which assesses the constitutionality of art. 9°-A for LEP. Then, legislative changes in genetic profiling introduced by the anti-crime package are analyzed, as well as new amendments currently under discussion in the National Congress. Subsequently, the ongoing relativization of individual rights in the Brazilian prison system and its implications are debated, in addition to encompassing considerations on the prospects for the usability of genetic material in criminal investigations. It is concluded that the norm violates the rights against self-incrimination and human dignity, demonstrating its unconstitutionality, making it necessary and urgent to align the Genetic Database with the 1988 Constitution.Acesso AbertoNão autoincriminaçãoDignidade da pessoa humanaFalibilidade do dnaSegurança públicaNon-self-incriminationHuman dignityFallibility of dnaPublic securityCNPQ::CIENCIAS SOCIAIS APLICADAS::DIREITOA constitucionalidade do art. 9º-a da lep: o julgamento do tema 905 no Supremo Tribunal FederalTrabalho de Curso - Graduação - MonografiaAttribution-NonCommercial-NoDerivatives 4.0 International
