The research stems from the contradiction between the official discourse on rehabilitation and the punitive reality of the Brazilian prison system, which frequently restricts essential rights under the justification of public security. Historically conceived as a mechanism for social inclusion and the progressive reintegration of inmates, temporary release has been significantly curtailed by the new legislation, intensifying debates about its purpose and effectiveness. This study employs a deductive approach and qualitative analysis of data obtained through documentary and bibliographic research techniques. The first section examines the legal framework of temporary release in Brazil, detailing its operation before and after the legislative reform. The second section demonstrates how the right to family and community interaction, recognized as a fundamental human right for inmates in legislation, is crucial for maintaining affective bonds, mental health, personal identity, and effective social reintegration. The third section presents a critical analysis of the prison system, showing how restricting this right lacks empirical support and instead reflects a logic of social control and penal hardening. The findings indicate that limiting temporary release violates inmates' human dignity and hinders their rehabilitation process, while also reinforcing the inherent segregation and social exclusion of the Brazilian prison system.
