Acesso em:.https://bdm.ufpa.br/handle/prefix/8278This study aims to provide a legal analysis of the applicability of Public-Private Partnerships (PPPs), in the strict sense, to freight railway infrastructure in Brazil. Based on the legal framework defined by Federal Law n° 11,079/2004, it is argued that PPPs are not suitable for the direct operation of railway transport under the open access model, but are legally viable and appropriate for the construction, maintenance, and potential management of permanent railway infrastructure. This is a qualitative and exploratory study grounded in legislative and doctrinal review, as well as the analysis of three emblematic projects: Ferrogrão, Nova Ferroeste, and Ferrovia Paraense. The study demonstrates that segmented contractual arrangements, combined with institutional strengthening and modernization of the legal framework — particularly through the New Legal Framework for PPPs (PL 7063/2017) — can improve legal certainty, investor appeal, and financial feasibility of railway infrastructure projects via PPPs.
