The methodology used in the work is hypothetical-deductive, bibliographic and qualitative-quantitative analysis of data extracted from the SISDEPEN. A priori, a historical analysis is made regarding the legislative evolution of children's human rights in national and international aspects, until the arrival of the doctrine of full protection and the recognition of children and adolescents as subjects of rights. Next, a profile of the incarcerated woman is drawn up with the aim of investigating who these mothers are and how the violation of their respective rights also extends to their children.
