The analysis demonstrates that this theory emerged as a response to unpredictable damages resulting from the limitations of scientific knowledge, aiming to balance technological innovation and consumer protection. In comparative law, the European Union expressly provides for the exclusion of development risks, although its effectiveness has been restricted by case law. The United States adopts a pragmatic solution based on evidentiary filters and sectoral compensation schemes, while Brazil rejects the exclusion, imposing full responsibility on suppliers even for unforeseeable defects. The study also highlights the role of the Brazilian State within the Unified Health System (SUS), where the distribution of medicines implies an inducement to consumption, which may generate subsidiary liability. It is concluded that the central issue lies in determining who should bear the inevitable costs of innovation: the industry, the State, or the consumer — a dilemma that reflects distinct policy choices in each legal system.Acesso AbertoRisco do desenvolvimentoExcludente de responsabilidadeRisco do produtoDireito do consumidorDevelopment riskExclusion of liabilityProduct riskConsumer rightsCNPQ::CIENCIAS SOCIAIS APLICADAS::DIREITORisco do desenvolvimento e responsabilidade civil: indústria farmacêutica, direito comparado e o papel do estado no SUSTrabalho de Curso - Graduação - ArtigoAttribution 3.0 Brazil
