Acesso em:.https://bdm.ufpa.br/handle/prefix/8272This monograph is focused on the analysis of article 32 of Law 9.605 of 1988, for the purpose of observing and describing the legal consequences of the finding of the insufficiency of the offending agent, in cases where the indication of low level of animal welfare, that is, where the finding of animal abuse occurs due to the insufficiency of the owner. To this end, ten cases are collected, with the purpose of demonstrating the legal consequences of the crime of mistreatment against domestic animals, with emphasis on the difficulty of determining the subjective element of the offending agent, the absence of which necessarily leads to the atypicality of the conduct.
