The research aims to analyze how the law can be abusively used to persecute and control women, focusing on the case ruled by the 8th Civil Chamber of the Court of Justice of the Federal District and Territories (TJDFT), which was considered the first case with a lawfare conviction in a Brazilian court. To this end, the study employs bibliographic and documentary research, analyzing judicial decisions and doctrinal references on lawfare, procedural violence, and gender. The study highlights how repetitive and unfounded actions filed by the plaintiff against his ex-wife constitute procedural harassment and bad-faith litigation, demonstrating the persistence of control and psychological violence after the end of the relationship. The research also examines the power asymmetry between the parties and the violation of the victim's fundamental rights, such as freedom and dignity, emphasizing the use of the judicial system as an extension of gender-based violence. Finally, this study underscores legislative and regulatory advances aimed at protecting women from abusive procedural practices, such as the Mariana Ferrer Law and CNJ Resolution No. 492, as well as the importance of a proactive judicial stance in addressing gendered lawfare.
