In pursuit of this objective, an initial discussion will be conducted on the system of evidence in criminal proceedings, analyzing its function and objectives. Subsequently, the specific type of evidence based on eyewitness identification will be addressed, problematizing it within a broader context. Upon examining these elements, the fragility of this type of evidence becomes evident, as it is entirely dependent on the memory of witnesses. For this reason, it was essential to conduct research on human memory, revealing its functioning and the need for an interdisciplinary approach within the legal process. Considering that eyewitness testimony, including identification, often plays a central role in establishing authorship, the investigation of false memories is also paramount.
