The research critiques the disconnect between the declared objectives of punishment and the degrading reality of the Brazilian prison system, adopting a minimalist perspective on the function of punishment. It emphasizes that while custodial sentences are a necessary evil, they must be strictly limited by respect for fundamental rights and due legal process. The study provides a historical-philosophical overview of punishment theory, assesses the compatibility of the Mandela Rules with Brazilian legislation, and analyzes significant jurisprudential decisions, such as ADPF nº 347. Furthermore, it exposes systemic issues such as overcrowding, unsanitary conditions, inadequate health services, and challenges in the social reintegration of inmates.
