Acesso em:.https://bdm.ufpa.br/jspui/handle/prefix/7483In general, the victim's word is the starting point for police and judicial analysis of libel cases, and the aim of this paper is to raise critical reflections on the role that the victim's statements play in these processes. To this end, we carried out a bibliographical review, documentary analysis of official data in Brazil, and analysis of case law from some state courts and our higher courts, in order to verify the impacts of the relevance of the victim's word in cases related to the crime of insult, whether simple, or racial and homophobic insult, with more serious penalties, drawing a parallel with domestic crimes, usually committed without the presence of witnesses, in order to verify how our judiciary deals with cases of insult in this scenario of scarce evidence. In addition, it is important to note that the Brazilian judiciary in cases of insult pays a lot of attention to the allegations made by the accused, since they bear the burden of proof and, if not proven, it is possible for the prosecution to move forward in these cases. Our conclusion is that, although it is of considerable importance, the victim's word in crimes of libel has its limits when lacking other evidence, since the Brazilian legal process constitutionally presumes the innocence of the accused, and in cases where only the words of the parties remain, there would be no possibility in our legal system of convicting the accused based solely on the words of the parties, Although there is the possibility of conviction through indirect witnesses or witnesses who only testified in the investigation, it is clear that it is important for the parties to be well-instructed, using the greatest possible degree of verification of their statements or those of third parties, in order to achieve their objective in the process.Acesso AbertoPalavra da vítimaValoraçãoInjúriaVictim's wordValuationInsultCNPQ::CIENCIAS SOCIAIS APLICADAS::DIREITOTrabalho de Curso - Graduação - Artigo
