Objective: to relate the phenomenon of judicialization of health in Brazil with the construction of a constitution influenced by symbolic constitutionalism and to answer the following question-problem: What is the connection between the Brazilian constitutional model of 1988 and the phenomenon of judicialization of health in Brazil? The hypothesis is that the model of symbolic construction of the Brazilian Constitution of 1988 maintains a close relationship with the current scenario of judicialization in the area of health. Methodology: This is a systematic, descriptive and historical research that deals with the theme and draws a parallel with the concept of symbolic constitutionalism by Marcelo Neves. Results: The historical review of health care in Brazil and the process of constitutionalization of the right to health allows the understanding of the current situation of the search for this guarantee of the right through the courts, since it is possible to verify that there was no concern with the effectiveness of the norm at the time of its formulation. Conclusion: the study demonstrates the intrinsic correlation between the growing judicial demand in the field of health and the constitutionalization of the right to health as a duty of the state in the Brazilian Constitution of 1988, resulting from, at the time, meeting the acute needs of the population.
