Acesso em:.https://bdm.ufpa.br/handle/prefix/10465This undergraduate thesis proposes a critical reflection on the concept of parental alienation, exploring its origins and its impact on the Brazilian legal system, based on a critical analysis of its foundational theory—the so-called Parental Alienation Syndrome (PAS). This analysis is carried out with a particular focus on the theory's negligible, if not entirely absent, scientific validity and recognition within the global academic community, as will be demonstrated throughout the text. Furthermore, the study examines the theory’s influence, incorporation, and formal codification into national legislation, most notably through the enactment of Law No. 12,318/2010, commonly referred to as the Parental Alienation Law. The paper also addresses the predominantly negative consequences of this law on Brazilian family dynamics, especially in the context of family disputes involving domestic violence and child sexual abuse. Through a qualitative investigation, grounded in bibliographic research and guided by a hypothetical deductive approach, the study demonstrates that Brazil has established a solid normative framework capable of ensuring the effective protection of the fundamental rights and best interests of children and adolescents.
