Acesso em:.https://bdm.ufpa.br/handle/prefix/10468The present study focuses on the challenges of applying Collective Habeas Corpus No. 143.641 - granted by the Federal Supreme Court (STF) - within the scope of the Court of Justice of the State of Pará (TJPA). The STF's decision, issued in February 2018, determined the replacement of preventive detention with house arrest for pregnant women, new mothers, and those with children up to 12 years old or with disabilities, except in cases of crimes committed with violence or serious threat, against their children, or in extremely exceptional situations. This decision represents a milestone in the protection of the fundamental rights of incarcerated women and their children. In this sense, an empirical, qualitative research approach was chosen, based on data obtained from the analysis of judicial processes, more specifically, TJPA rulings that address the topic. The survey conducted on the TJPA website, using February 2025 as the cutoff date and filtering for the terms "house arrest" and "pregnancy," identified 114 decisions, of which 43 specifically dealt with requests for the granting of house arrest for pregnant women or mothers of children up to 12 years old/with disabilities. The preliminary results found indicate that, although the STF established clear parameters, the application in the TJPA is not uniform, revealing the reproduction of gender stereotypes in judicial decisions, which negatively affected the effectiveness of the granted right. The research thus contributes to the construction of empirical evidence regarding obstacles to access to justice for women, contributing to the debate on gender, women's human rights, and criminal policy in Brazil, pointing out the contradiction between the STF's decision and the TJPA's practice.Acesso AbertoMaternidadeHabeas corpus coletivo nº 143.641Tribunal de Justiça do Estado do ParáDireitos humanosMotherhoodCollective habeas corpus nº 143.641Court of justice of the state of ParáHuman rightsCNPQ::CIENCIAS SOCIAIS APLICADAS::DIREITOMaternidade no cárcere: desafios da aplicação do habeas corpus coletivo nº 143.641/STF no estado do ParáMotherhood in prison: challenges in the application of collective habeas corpus nº 143.641/STF in the state of ParáTrabalho de Curso - Graduação - ArtigoAttribution-NonCommercial-NoDerivs 3.0 Brazil
