Acesso em:.https://bdm.ufpa.br/handle/prefix/8276This article aims to address the multidimensional phenomenon of menstrual indignity, particularly within the Brazilian prison system, analyzing how this violation constitutes a form of gender-based violence against incarcerated women. Consequently, the lack of access to menstrual hygiene products, adequate infrastructure, information, and healthcare exacerbates the violation of human rights for the female prison population. Menstruation, often stigmatized, is a natural and physiological process that, when neglected, results in severe violations of women's fundamental rights, particularly regarding health, hygiene, and, above all, human dignity. The research employs a qualitative method, based on a literature review, analysis of national and international legal frameworks, and statistical data on the Brazilian prison system. The findings reveal the alarming reality of menstrual poverty in Brazilian prisons, where women frequently resort to inadequate and improvised materials to manage menstrual flow, exposing themselves to the risk of diseases and infections. Despite recent legislative advancements, such as the establishment of the Menstrual Health Protection Program, significant gaps remain in the mechanisms for protecting and enforcing this right, alongside challenges in implementing existing measures.
